This poll is mainly talking about a specific RL design that someone in SL creates a direct copy of, by which I mean you wouldn't be able to tell them apart if one wasn't virtual. Do you believe the SL designer owes it to their customers to inform them if their latest release actually existed already? Or perhaps the two realities do not have crossover rights or obligations?
For more information I refer you to a piece on SCD about designing off a well-known creator . Do you also believe all logos are sacred and copyright? Or do you think that aspects of logos in RL are fair game in SL?

Ok, ethically I don't have a problem with it. If the SL designer acknowledges he original.To me it's like avoiding plagerism in writing. You can quote other people but you have to credit the quote to the correct source. Legally, I think that if a RL designer knew that someone was making money off their design they could sue them for either part of their profits or for waaaay more for copyright infringement. I think as Second Life becomes more mainstream and more RL companies start becoming aware of it, this danger increases.
I don't think you should use a direct copy of their logo...that could be trouble down the line as SL opens up more..and personally I think if you are directly "inspired by" something already out there, you should say so, that way if someone does find something just like it, you appear like you're not hiding anything....there's nothing wrong with that..being inspired by others is commonplace in fashion.
One shouldn't use their logo - that's Trademark infringement. As for copying the design, fashion - RL fashion - does not fall under copyright law. So while there is a legal issue with trademark usage, there really isn't a legal issue with copying a design from RL to SL - unless you are photosourcing from photos you don't have a right to.
I don't think its a big deal if designers take inspiration from RL clothing and bring them into SL without attribution... as long as they can accept the fact that they may/will lose face when it inevitable makes its way into the blogosphere.
Theres a shop called "Redgrave" who i hold no respect for at all. A TM belongs to one owner, and this brand Redgrave you can see even the logo of the real world designer on their clothing. Big thumbs down. Also no creative ability on their end since theyre just using RL outfits.
I prefer to buy from either people who hand draw, or people who mix a bit of RL fabrics and folds along with their own drawing and style!
